Terms of Use

1. The Service

On the web, Tug of Math is an educational math game designed for classroom use on interactive whiteboards. It includes a free whiteboard game, optional user accounts, multiplayer functionality, and premium subscription plans.

The app is made for families. Two children play head to head on one device, or one child plays the computer or the clock. It needs no account to play and it works offline.

These Terms cover both.

2. Accounts

• An account is not required to play. On the web the whiteboard game works without one; in the app the device is given an account of its own, so that your games and anything you buy are remembered without an email address
• If you create an account, you must provide accurate information
• You are responsible for maintaining the security of your account and password
• You must notify us immediately of any unauthorized use of your account
• You must be at least 16 years old to create an account or to make a purchase. Children may play under the supervision of a parent or guardian, but the account holder is the adult.

3. Acceptable Use

You agree not to:

• Abuse, disrupt, or overload the service or its infrastructure
• Use automated tools to access the service without permission
• Reverse-engineer, decompile, or attempt to extract source code
• Impersonate other users or misrepresent your identity
• Use the service for any unlawful or harmful purpose

4. Subscriptions & Payments

How you pay, and who you pay, depends on where you subscribed.

Bought on the web

• Premium plans (Pro and School) are available as monthly or yearly subscriptions
• Payments are processed securely through Stripe
• You can cancel your subscription at any time through the billing portal
• After cancellation, you retain access until the end of your current billing period
• We do not offer refunds for partial billing periods, except where the law requires us to
• We may change subscription prices with 30 days' notice

Bought in the app

• The app offers a Family subscription, monthly or yearly, and a one-off pack of games. Where a subscription starts with a free trial, its length and the price after it are shown before you buy.
• You buy from Apple or Google, not from us. The purchase is also governed by the App Store or Google Play terms, and they take the payment and hold your payment details.
• A subscription renews automatically for another period unless you cancel it at least 24 hours before the current one ends
• You cancel in your App Store or Google Play account settings. We cannot cancel a store subscription for you.
• Deleting your Tug of Math account does not cancel a store subscription. Cancel it in the store first.
• Refunds for store purchases are handled by Apple or Google under their own policies, not by us
• Prices are shown in your own currency in the store before you buy. We may change them, and the store will tell you before it renews at a higher price.

5. The Apps

• The Tug of Math apps are distributed through the Apple App Store and Google Play, and your use of those stores is governed by their terms as well as these
• On iPhone and iPad, your license to use the app itself is Apple's standard Licensed Application End User License Agreement. These Terms cover the Tug of Math service around it: your account, your content, your subscription, and what we owe each other.
• We grant you a personal, non-exclusive, non-transferable license to use the app on devices you own or control, for your own household
• The app plays offline. Results are sent to us when the device is next online, and what a subscription entitles you to is confirmed against our servers rather than taken from the device alone.
• We may update the app. Some features may need a recent version, a recent operating system, or an internet connection.

6. Your Content

• You retain ownership of content you create, such as custom problem sets
• By using the service, you grant us a limited license to store and display your content as necessary to provide the service
• Content shared within an organization is accessible to other members of that organization

7. Intellectual Property

Tug of Math, including its design, code, and branding, is our intellectual property. You may not copy, modify, or distribute any part of the service without permission.

8. Service Availability

We strive to keep Tug of Math available at all times, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. Real-time multiplayer features depend on third-party infrastructure and may occasionally experience disruptions.

9. Limitation of Liability

Tug of Math is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim. Nothing in these Terms limits rights you have under mandatory consumer law.

10. Termination

• You may delete your account at any time: in the app from Settings, and on the web by contacting us at [email protected]
• Deleting your account does not cancel a subscription bought from Apple or Google. Cancel that in your store account settings first.
• We may suspend or terminate your account if you violate these Terms
• Upon termination, your right to use the service ceases. Your data will be handled according to our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes shall be resolved by the competent courts in the Netherlands.
